Found one and paypal was sent. Hopefully I get it this next week. I always worry when someone has one last name on their email and then the last name on their paypal is different. We will see:~:

So I got hosed. The light came and all the tabs are broken off. I specifically asked about the condition of the tabs and he said everything looked good. I just emailed him after getting the package and I told him of the tabs. He replied and said "I guess you should file a claim with the shipping company as everything was fine when I sent it."

At least I used paypal so that if he doesn't work with me I can at least file some sort of claim.

Except the shipper has to file the claim. Your problem is not with UPS (or whoever), it's with him. Tell him you want your money back and it's up to him if he wants to get refunded from the carrier.

Then plaster his scammer ass name all over NASIOC for being a douche.

Yeah, I have no intention of filing a claim with FedEx for something that we both know they didn't do. I'm trying to be chill about it right now but he might make that difficult. I sent him with an email with pictures(not that he needs them) and requesting a refund. If not I will file with paypal.

And whether or not the lights were "fine" before he sent them, as the seller he's responsible for getting them to you in the described condition. Even it FedEx broke them, he's required to make it right since he's got your money... FedEx didn't break your light, they broke *his* light. It's not yours because the transaction was never completed as per your agreement.

So an update.

This was by far the worst package I have ever gotten in the mail. First, the cardboard box was very sickly. You could tell it had been out in the weather for some time. I could have literally stuck my hand directly into it Temple of Doom style. Then I opened it up and was punched in the face with the smell of cat piss. Its the first time I had to open a package outside of my house. At least he happened to throw in a grip of oily bubble wrap. :rolleyes:

So of course the first thing I notice is the tabs are broken. They didn't look like fresh breaks but I still looked in the bottom of the box for pieces. There were none. So that's when I emailed him and he said "oh it must be FedEx". So then of course I tell him he needs to refund my money. Now he comes back and says " oh yeah, that's my brothers PayPal and I'm probably not gonna see him until Saturday since we work different shifts."

So I filed a claim with PayPal and told him he has 24hrs to talk to his "brother" and refund my money. I then read on many forums that PayPal will probably screw me anyways and let him get away with it. So tomorrow I will probably just call VISA and have them fix it.

I bought a used item from the guy, and the item he sent me was broken despite my specific inquiry into its condition and his statements that it was in good working condition.

PayPal: We'll get back to you when we hear from the seller.

Seller: That shit was fine when I sent it out, yo.

PayPal: We are sorry, but we cannot refund your money. The seller says he sent you good shit.

I don't know, every time I've filed a PP dispute because something was damaged they have decided in my favor. I think you have a pretty good chance of winning since the broken pieces are not in the box.

Seriously though, probably 75% of the packages I get from private sellers are inadequately packed. Like when you buy a $200 stereo and the seller just drops it in a flat rate box with nothing to protect it. Sometimes I get lucky and the item makes it despite the piss poor packaging.

How long did you wait until you elevated the dispute to a claim?

Well, in your case I would do it after 24 hours like you said. The dude already sounds like he isn't giving your money back willingly. If the seller doesn't respond at all I wait a couple of days max.

Sounds like it was intentionally packed like crap specifically so he could blame FedEx. What a shady dickhole.

Douche needs to be black listed on nasioc and locked out of his paypal. As soon as you have your money back, you should send this thread to the nasioc mods. They don't take kindly to scammers like this.

It's been about ten years since I was screwed similarly (~8 years) but when neither eBay nor Paypal would do the right thing, my credit card company had no problem reversing the charges for me. Paypal, in turn, must have taken the money back from the shipper because he immediately contacted me and requested that I return the speakers (the issue was that the tweeters were missing). I informed him that I would be happy to if he would simply send a call-tag (so he pays for and arranges shipping) which he promptly did.

I had an issue with a gear i bought from someone on nasioc (jay storms) gear was the wrong ratio and he kept telling me he was looking through his garage. (i think he was) but as time passed he stopped being responsive to Pms on nasioc. i tried to start a dispute with pay pal but i was past the cut off time. think i did a direct bank transfer for pay pal so i didn't have the visa charge back (nuclear option) on the table.

but i ended up E-thuging him on nasioc (posting in all of his current threads, asking about a refund, or at least to be contacted) and he actually refunded my money .

I felt a bit bad, but i was going weeks with out any response , when you can clearly see him logging in and posting every day, figured he was trying to ignore me until i went away. but $115 for the wrong gear is lame.

i still need to mail him back the gear but he was pretty pissed and didn't care either way, and i have to get the gear from toms...

anywho , you're dead on filing a dispute 24 hours later!
