No, just the opposite in fact. If someone pulls a gun on me, I assume its loaded and freak out. I would assume that everyone else in their right mind would as well. But you never know who else is holding. Thus...
Person 1 pulls an unloaded gun out (like an idiot).
Person 2 thinks "Shit, someone just pulled a gun on me, I should pull my loaded one out"
Person 1 shits himself
Person 2 pulls the trigger and Person 1 is now Dead Person 1.

Person 2 thinks "Shit someone just pulled a gun on me, I need to GTFO"
or
Person 1 pulls an unloaded gun out (like an idiot).
Person 2 thinks "Shit, my life is on the line I need to fight like it counts" and beats the shit out of Person 1; Whom is now either Seriously Wounded Person 1 or Dead Person 1.
Personally, I'd rather be alive than succeed bluffing w/ an unloaded gun, so the better theory is 'Don't pull a gun out unless you can and will use it' and Q.E.D. only an idiot would pull an unloaded gun on a stranger.
And by the way, the law sides with Person 2 in the two bad scenarios because their life was threatened.
